AMAYA FOREVER MOMENTS
PHOTO BOOTH BOOKING AGREEMENT
This Booking Agreement applies to photo booth services provided by Amaya Forever Moments. By submitting a booking form, the Client acknowledges that they have reviewed and agree to these terms.
1. SERVICES, PACKAGE & PAYMENT
Amaya Forever Moments (“Company”) will provide the photo booth services, equipment, backdrop(s), props, digital services, printing, and/or other add-ons selected by the Client and listed in the booking or service summary associated with the event.
A non-refundable retainer equal to fifty percent (50%) of the total contract price is due upon booking. The retainer reserves the event date and is applied toward the total balance.
The remaining balance is due thirty (30) days before the event date. If an event is booked less than thirty (30) days before the event date, the full balance is due at booking unless otherwise agreed in writing.
Any approved additional services, upgrades, overtime, or other charges not included in the original booking may be added to the Client’s balance. Overtime, when available, will be charged at the rate stated in the booking or service summary and may be billed in half-hour increments.
2. SERVICE PERIOD & OPERATION
Company agrees to make reasonable efforts to have the photo booth operational throughout the contracted service period. The booth may occasionally be unavailable for short periods for maintenance, troubleshooting, media changes, or other necessary service. Company will make reasonable efforts to restore service as promptly as possible.
3. CHANGES & CANCELLATIONS
Requests to change the event date, time, venue, or other material booking details must be made in writing at least thirty (30) days before the original event date. Changes are subject to Company availability and may require a revised service agreement.
If an alternate date or time is unavailable, the original retainer will remain forfeited and no services will be provided for the original event date.
If the Client cancels less than thirty (30) days before the event date, all payments received will be forfeited. Company may, at its discretion, consider rescheduling requests based on availability.
4. VENUE ACCESS, SPACE, PARKING & POWER
Client is responsible for arranging an appropriate, safe, level, and solid area for the photo booth. Unless otherwise agreed, a minimum area of approximately 6 feet by 9 feet is recommended.
Client is responsible for ensuring reasonable access for setup and breakdown and for providing any required venue/vendor credentials, permits, elevator access, loading access, or parking arrangements. Parking should be reasonably close to the venue when possible.
Client must provide a functioning standard 110V, 3-prong electrical outlet suitable for the equipment. Client is responsible for confirming that the venue permits the photo booth and for complying with venue rules.
Outdoor placement is permitted only when the equipment is adequately protected from weather, direct moisture, excessive heat, and other conditions that could damage or interfere with the equipment.
5. WIFI / DIGITAL DELIVERY
Certain features, including online sharing or social-media functions, may require a venue internet connection. Company is not responsible for interruptions or limitations caused by insufficient or unavailable venue internet service.
When Company provides a downloadable online gallery or digital files, Client is responsible for downloading, storing, and backing up those files. Company is not responsible for Client’s failure to download or preserve files after delivery.
6. BACKDROPS, PROPS & EQUIPMENT
Company will provide the backdrops, props, and equipment included in the Client’s selected package or add-ons. Specific selections may be subject to availability.
Company may substitute an item with a comparable item when necessary due to damage, loss, availability, safety, or circumstances outside Company’s reasonable control.
Client and event guests agree to use Company equipment, props, and backdrops responsibly. Client may be responsible for repair or replacement costs resulting from intentional, reckless, or negligent damage caused by Client, guests, or persons under Client’s control.
7. PRINT DESIGN & CUSTOMIZATION
When custom print designs are included, Company may create the design using materials supplied by Client, including logos, fonts, monograms, colors, and ideas.
Company will provide a draft and one reasonable revision unless otherwise stated in the booking. Additional design work may be subject to an additional fee agreed upon before the work is completed.
8. PHOTO / MODEL RELEASE
Unless Client provides written notice before the event requesting that event images not be used for promotional purposes, Client grants Company permission to use photographs produced through the photo booth for Company’s portfolio, website, social media, advertising, and other legitimate business promotional purposes.
Client represents that Client has authority to agree to this use for the event and understands that guests may appear in photographs. Client is responsible for notifying guests of any applicable photo or privacy restrictions.
Client may request in writing that Company not use images from the event for promotional purposes.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Amaya Forever Moments and its owners, employees, contractors, and agents will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from or related to the services, except where such limitation is not permitted by applicable law.
Company is not responsible for service interruptions caused by circumstances beyond its reasonable control, including venue restrictions, power failure, internet failure, equipment failure not caused by Company’s negligence, severe weather, accidents, illness, delays, or other events outside Company’s reasonable control.
If Company is unable to provide the contracted service and no reasonable substitute or replacement service is provided, Company’s maximum liability will be limited to the amount actually paid by Client for the affected services, to the extent permitted by law.
10. CLIENT RESPONSIBILITY & INDEMNIFICATION
Client agrees to maintain a safe environment for Company personnel and equipment and to comply with venue rules.
Client agrees to be responsible for claims, damages, losses, or expenses arising from Client’s or guests’ intentional, reckless, or negligent conduct, to the extent permitted by law.
11. DISPUTE RESOLUTION & GOVERNING LAW

If the dispute cannot be resolved informally, the parties agree to attempt mediation before litigation, where permitted and appropriate.
The agreement will be governed by the laws applicable to Company’s principal place of business, subject to applicable law.
12. ENTIRE AGREEMENT
This Agreement, together with the Client’s booking, package selection, add-ons, invoices, and any written amendments accepted by both parties, constitutes the entire agreement between Client and Amaya Forever Moments regarding the event services.
Any material modification should be made in writing and accepted by both parties.
